WHAT CHANGED — OLD TEST VS NEW TEST
USCIS implemented a new civics test on October 20, 2025. Here's exactly what is different:
📋 Old Test (2008 version — for N-400 filed before Oct 20, 2025)
• 100 total possible questions
• Officer asks up to 10 questions
• Must answer 6 correctly to pass
• Test stops when you pass or fail
✅ New Test (2025 version — for N-400 filed on or after Oct 20, 2025)
• 128 total possible questions
• Officer asks 20 randomly selected questions
• Must answer 12 correctly to pass
• Test stops when you reach 12 correct or 9 incorrect
WHO MUST TAKE THE NEW TEST
The single most important factor is your N-400 filing date — not your interview date.
- Filed before October 20, 2025 → You take the old 100-question (2008) test regardless of when your interview is scheduled
- Filed on or after October 20, 2025 → You take the new 128-question test
- Not sure? Check your Form I-797 receipt notice — it shows your filing date

- 55/15 exception — 55 years or older AND permanent resident for 15+ years → take test in your language

STUDY TIPS TO PASS THE FIRST TIME
1. KNOW YOUR STATE-SPECIFIC ANSWERS
Several questions have answers that depend on where you live — your Governor, U.S. Senators, and U.S. Representative. Look these up before your interview and memorize the current names. Officials change, so verify at the time of your interview.
2. KNOW THE CURRENT PRESIDENT AND VICE PRESIDENT
As of 2025–2026: President is Donald Trump, Vice President is JD Vance. These answers change with elections so always verify before your interview.
3. PRACTICE OUT LOUD
The test is oral. You must say your answers verbally to the USCIS officer. Many people know the answers but freeze when speaking. Practice answering out loud, not just reading silently.
4. FOCUS ON THE HIGHEST-PROBABILITY QUESTIONS
20 questions are randomly selected from 128. Questions about the President, Congress, Bill of Rights, and flag are asked most frequently. Study those first.
5. IF YOU FAIL, YOU GET ONE MORE CHANCE
USCIS will schedule a re-examination of only the failed portion within 60–90 days. If you fail the second time, your N-400 will be denied. You can reapply but will pay the filing fee again.
PRACTICE ALL 128 QUESTIONS WITH AI FEEDBACK
LEGALIAI walks you through all 128 civics questions with AI feedback on your answers — in English, Spanish, Portuguese, Chinese, Tagalog, Vietnamese, or Hindi. Know exactly where you stand before your interview day.
